Driving While Intoxicated

According to Arkansas State Statute 5-65-103 it is unlawful for any person who is intoxicated to operate a motor vehicle. Section b of the statute states that any person with a blood alcohol level of.08% and above is considered to be intoxicated. The formal charge is Driving While Intoxicated.

Driving Under the Influence

State Statute 5-65-303 makes it unlawful for any underage person to operate a motor vehicle while under the influence of an alcoholic beverage or similar intoxicant. Section b states that an underage person (under 21) with a blood alcohol level of at least.02% but less than.08% is considered to be under the influence.
